Terms of Use

1. What this covers

These terms apply to the project websites and to hosted services run by the author, including download and repository endpoints and any account or API functions. They do not replace the Research Software Notice (00-RESEARCH-SOFTWARE-NOTICE.md), the liability terms (02-LIMITATION-OF-LIABILITY.md), the Locker terms (04-LOCKER-SERVICE-TERMS.md), or the licences that ship with specific software (including UIL-Labs-EULA). If there is a conflict, the more specific document controls for the specific subject.

2. Acceptance

By using a website or hosted service you agree to these terms. If you do not agree, do not use them.

3. Acceptable use

You may use the websites and hosted services for their intended purposes: learning about and testing takhiOS and the UIL Platform, downloading releases, reporting problems, and community discussion. You must follow all laws that apply to you.

4. Prohibited use

You must not:

  • use the services for anything unlawful, or to store, distribute or link to unlawful material;
  • interfere with the services or the infrastructure they run on, including denial-of-service attempts, resource exhaustion, port scanning, or probing for vulnerabilities outside 05-SECURITY-DISCLOSURE.md;
  • attempt to access accounts, data or systems you do not own or have permission to access;
  • upload malware, or use the services to attack or deceive others;
  • automate requests in a way that degrades the service for others;
  • misrepresent the project, or imply that the author endorses you or your product.

5. Intellectual property

The software, text, names and logos are owned by the author or their respective owners. Your rights are only those granted in the applicable licence (UIL-Labs-EULA for the UIL Platform, other licences for third-party and GPL components). Nothing here transfers ownership. Trademark and name use is covered by 06-TRADEMARK-USAGE.md.

6. User content

If a service lets you submit or store content (for example files, image files, comments or issue text), you keep ownership of it. You grant the author a limited licence to host, process and back up that content only as needed to run the service, and to disclose it if required by law. You confirm you have the right to submit it. Do not submit content you cannot lawfully store or share.

7. Availability and changes

Services are provided free and as available. There is no availability commitment. The author may add, change, limit, suspend or discontinue any part of them at any time. Where a change is material and practical to announce, reasonable notice will be given. See 04-LOCKER-SERVICE-TERMS.md for the Locker.

8. Suspension and termination

Access may be suspended or ended if you breach these terms, if use creates risk to the service or to others, or if the service is being discontinued. Where it is practical, notice is given.

9. Donations

Donations are voluntary gifts. They are not payment for goods or services, and nothing is provided in exchange for them. Donations are non-refundable unless the payment provider or mandatory consumer law requires otherwise. Donating does not create a customer relationship, a support entitlement or a promise of continued development.

The websites may link to third-party sites, payment providers, hosting providers or package repositories. Those are governed by their own terms and privacy practices, and the author does not control them.

11. Governing law and venue

These terms are governed by the laws of Norway. Disputes are subject to the jurisdiction of the Norwegian courts, without prejudice to any mandatory rights you have where you live. See the carve-outs in 02-LIMITATION-OF-LIABILITY.md.

12. Severability

If a provision is held invalid or unenforceable, the rest stays in force and the invalid provision is replaced by the closest valid one.

13. Changes to these terms

These terms may be updated. Each update gets a new version and effective date. Continued use after the effective date means you accept the updated terms. Each release keeps the terms it shipped with.
